This privacy policy (this “Privacy Policy”) of the BBucks Labs, Inc. (referred to herein as "BeraBucks", "we", "our", or "us") provides information about the collection, processing, and use of your personal data when accessing and using products (collectively, “Products”) available on our websites such as www.BeraBucks.com and any other website, web application, or mobile application exclusively controlled and operated by us (collectively, the “Websites”).
By accessing or using any of the Products, you agree that you have read, understand, and agree to be bound by this Privacy Policy and our Terms of Use available at www.BeraBucks.com. If you do not agree, you are not authorized to access or use any of the Products and should not use the Products.

1. Collection of User Information.

For purposes of this Privacy Policy, “User Information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, in particular by reference to an identifier such as a name, and identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of visitors to the Websites or users of the Products (“user(s),” “you,” or “your”). “User Information” does not include aggregated or de-identified information that is maintained in a form that is not reasonably capable of being associated with or linked to you (“Anonymized Data”).

1.1. User Information We May Collect.

While the User Information we collect varies depending upon the circumstances, we may collect the following User Information (subject to applicable legal requirements and restrictions):

  • Name, contact information, and other identifiers: identifiers such as a name, username, account name, blockchain address, address, phone number, birth date, email address, and online identifier.

  • User records: electronic customer records containing User Information. We may also collect your payment information that is processed by our third party payment processor.

  • Blockchain information: your wallet address, on-chain activities, interactions with the Products on the blockchain, and other similar activities.

  • Device information: internet protocol (IP) address, web browser type, operating system version, phone carrier and manufacturer, application installations, device identifiers, mobile advertising identifiers, and push notification tokens.

  • Protected classifications: characteristics of protected classifications under applicable law such as race, sex, age, and disability.

  • Communications: direct communication, web forms, online polls, or interactions with our Website content.

  • Commercial information: including records of products or services purchased, obtained, or considered, or other purchasing or use histories or tendencies.

  • Usage data: internet or other electronic network activity information including, but not limited to, browsing history, search history, and information regarding users’ interactions with an Internet website, application, or advertisement.

  • Location data: location information about a particular individual or device, general location information (for example, your IP address may indicate your more general geographic region). However, this information is not precise geolocation.

  • Profiles and inferences: inferences drawn from any of the information identified above to create a profile reflecting a user’s preferences.

1.2. Sources of User Information We May Collect.

1.2.1. Information We May Collect From You (either directly from you, or by combining information we collect and maintain through other means, such as service providers and partners, or as we may receive from publicly available sources such as social media or other third-party sites).

  • Registration, accounts and profiles: when you create a user account with us (a “User Account”), we facilitate the collection of your blockchain address(es) and usernames and email address; if you choose to connect third party services to your User Account, we may collect the information about those third party services; we may also collect additional information such as your preferences and payment details.

  • Marketing, surveys and events: if you sign up to receive news, updates, offers and other marketing communications from us, or attend any events or participate in any activities hosted through our Website, we may collect your name, contact information, and information about your preferences.

  • Your communications and requests: when you email us or otherwise send us communications, we collect and maintain a record of your contact details and communications, and our responses.

1.2.2. Information We May Collect from Third Parties.

  • Third-party accounts: if you connect your third party accounts to your User Account, we will collect certain personal data about you from those third parties accounts.

  • Purchases, orders, and payments: if you purchase any blockchain assets, or sign up for certain Products, we collect information in order to process your payment, such as your name, billing address, payment type, as well as credit card number or other payment account details.

  • Social media: if you choose to link, create, or log in to your User Account with a social media service, we collect your permission to access certain information from your profile with that social media service. If you post or if you engage with a separate social media service or interact with us on our page with any social media service, we may collect User Information about you related to those interactions.

  • Other: we may obtain User Information, such as demographic information or updated contact details, from third parties; we may also collect information from public records.

1.2.3. Information We May Collect or Derive About You Automatically.

  • Websites and Applications: We and our third-party providers may use cookies, pixels, tags, log-files, and other technologies to collect information about a user from their browser or device, including, without limitation, your browser type, device type, operating system, software version, phone model, phone operating system, platform-dependent information, requested document, referring URL, date and time of your visit, clickstream data (e.g., about the pages you view, links you click and date and time stamps for your activities on our Websites), and the IP address associated with your transactions in the system. The information that we collect automatically may be linked with other User Information we have collected.

  1. Use of User Information.

We may use your User Information for the following purposes:

  • Providing the Products: to provide and maintain the Products and features of the Products.
  • Analyzing and improving our business: to better understand how you access and use of the Products, customize and improve the Products and features of the Products, and develop new features and products.
  • Advertisement and marketing: to advertise and promote the Products.
  • Customer support: to provide customer support for and answer inquiries about the Products.
  • Safety and security: to protect against, investigate, and stop fraudulent, unauthorized, or illegal activity. We may also use it to address security risks, solve potential security issues such as bugs, enforce our agreements, and protect our users and us.
  • Legal compliance: as needed or requested by regulators, government entities, and law enforcement to comply with applicable laws and regulations.
  • Defending our rights: to manage and respond to actual and potential legal disputes and claims, and to otherwise establish, defend, or protect our rights or interests, including in the context of anticipated or actual litigation with third parties.
  • Audits, corporate governance, and internal operations: related to financial, tax and accounting audits; audits and assessments of our operations, privacy, security, and financial controls, risk, and compliance with legal obligations; our general business, accounting, record keeping and legal functions; and related to any actual or contemplated merger, acquisition, asset sale or transfer, financing, bankruptcy or restructuring of all or part of our business.

3. Disclosure of User Information.

We may share or disclose the User Information we collect as follows:

  • Service providers: with third-party service providers who use User Information to perform services for us, such as hosting providers, auditors, advisors, consultants, customer service and/or support providers.
  • Advertising and Marketing Partners: with third parties that provide advertising, campaign measurement, online and/or mobile analytics, and related services. These third parties may receive or access browsing and/or other data about your use of the Products, in order to help us better reach individuals with relevant ads and/or measure our ad campaigns, and/or to better understand how individuals interact with the Products over time and across devices.
  • Subsidiaries, affiliates, and business partners: with our affiliated companies (i.e., our parent company and other companies under common ownership, control or management with us; and business partners to offer exclusive content on the Products); they may use such User Information for the purposes set out in this Privacy Policy.
  • Legal compliance: in response to a valid court order, subpoena, government investigation, or as otherwise required by law. We also reserve the right to report to law enforcement agencies any activities that we, in good faith, believe to be unlawful. In addition, we may share certain User Information when we believe that doing so is reasonably necessary to protect the rights, property and safety of our company and/or others.
  • Business transfers: We may disclose and/or transfer User Information as part of any actual or contemplated merger, sale, transfer of assets, acquisition, financing and/or restructuring of all or part of our business, bankruptcy or similar event, including related to due diligence conducted prior to such event where permitted by law.
  • Protect our rights: We may disclose User Information where we believe it is necessary to respond to claims asserted against us, to enforce or administer our agreements and terms, for fraud prevention, risk assessment, investigation and/or to protect the rights, property, or safety of BeraBucks or our affiliates, partners, clients, customers and/or others.

  1. Retention of User Information.

Except to the extent prohibited by law, and as permitted under this Privacy Policy, we will retain and use your User Information for as long as it is needed to provide you with any products, services, communications, information you have requested, or access to the Websites, to document our business relationship with you, and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

5. Cookies.

Cookies and other similar technologies, such as web beacons (collectively, “Cookies”) enable websites and applications to store information or facilitate access to information stored on your device to enable certain features and distinguish you from other visitors.

We use Cookies, which may be provided by third parties, on our Products to enable certain functionality and for security and fraud detection and prevention, as well as to collect usage information about our Websites and the emails that we send and to personalize content and provide more relevant ads and information. We may combine the information we collect via these technologies with other information, including User Information.

You can manage Cookies using your browser settings. We do not control the use of third party cookies and recommend that you review the privacy policies of third party providers to understand how they use Cookies and your personal data. 6. Third-Party Links and Sites.

We may integrate technologies operated or controlled by other parties into parts of the Products. For example, the Products may include links that hyperlink to websites, platforms, and other services not operated or controlled by us. Please note that when you interact with these other parties, including when you leave the Websites, those parties may independently collect personal data about you and solicit information from you. 7. Age Requirements.

You are not allowed to use this product if you are under the age of 18. The Products are restricted to users of legal age and children under the age of 18 are not allowed to use the Products. We do not knowingly collect or maintain User Information from children we actually know at the time of collection are under the age of 18. Should we discover that we have collected User Information online from a child who is under 18, we will promptly delete that User Information. If you have concerns over the collection of children’s User Information on the Products, please contact us at the email address provided in Section 10 below.

8. Security.

We implement and maintain reasonable administrative, physical, and technical security safeguards to help protect data from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. Nevertheless, transmission via the internet is not completely secure and we cannot guarantee the security of information about you. You are responsible for all of your activity on the Products, including the security of your blockchain network addresses, cryptocurrency wallets, and their cryptographic keys.

9. Changes to this Privacy Policy.

This Privacy Policy is kept under regular review and may be updated from time to time. When we make changes to this Privacy Policy, we will change the “Effective Date” above. If a material change is made to this Privacy Policy, we may choose to provide notice to you in advance of such change, such as by posting notice of that change on the first page of this Privacy Policy or on our homepage, or by sending an email to the email address we have on record for you.
